PUBLIC NOTICE - PROPOSED ANIMAL MANAGEMENT (AMENDMENT) SUBORDINATE LOCAL LAW (NO. 1) 2019

PUBLIC NOTICE

Local Government Act 2009

 

  1. Banana Shire Council (“Council”) has proposed to make Animal Management (Amendment) Subordinate Local Law (No. 1) 2019.
  2. Local Law No. 2 (Animal Management) 2011 authorises the making of Animal Management (Amendment) Subordinate Local Law (No. 1) 2019.
  3. Animal Management (Amendment) Subordinate Local Law (No. 1) 2019 amends Subordinate Local Law No. 2 (Animal Management) 2011.
  4. The purpose and general effect of Animal Management (Amendment) Subordinate Local Law (No. 1) 2019 is to —
    1. by reference to the planning scheme for the local government area, prescribe areas in which the keeping of an animal or animals is prohibited; and
    2. by a reference to the planning scheme for the local government area, prescribed areas in which the keeping of an animal or animals requires an approval; and
    3. prescribe minimum standards about dog noise nuisance; and
    4. designate an area as a dog off-leash area. 
  5. Written submissions by any person in support of, or objecting to, the proposed subordinate local law referred to in paragraph 1 are invited for a 21 day period commencing on 8 March 2019 and ending on 29 March 2019 (the “consultation period”). 
  6. During the consultation period Council will make available for inspection and purchase at Council’s public office at 62 Valentine Plains Road, Biloela, 18 Yaldwyn Street, Taroom and 43-47 Gillespie Street, Moura copies of the proposed subordinate local law referred to in paragraph 1.
  7. Submissions must be received on or before 29 March 2019 stating—
    1. the grounds of the submission; and
    2. the facts and circumstances relied on in support of the grounds.
